These Terms apply to all orders placed through our online store.

Individual agreements made with customers shall take precedence over these Terms where applicable.

3. Products

We make every effort to ensure that product descriptions, images, specifications, and prices are accurate.

Minor deviations in color, appearance, or packaging caused by production processes or screen settings do not constitute defects.

4. Conclusion of Contract

The presentation of products in our online store does not constitute a legally binding offer.

By submitting an order, you make a binding offer to purchase the selected products.

The purchase contract is concluded only when we accept your order by sending an order confirmation or by dispatching the goods.

5. Prices

Unless otherwise stated, all prices shown include applicable VAT where legally required.

Shipping costs, customs duties, taxes, or import fees may apply depending on the destination country and are displayed separately where applicable.

Customers are responsible for any import duties, customs fees, or local taxes imposed by their country.

Payment must be completed before shipment unless otherwise agreed.

7. Shipping

We ship worldwide.

Delivery times are estimates only and may vary depending on destination, customs clearance, weather conditions, or carrier delays.

Orders are shipped using DHL or another suitable logistics partner where necessary.

Risk transfers to consumers in accordance with applicable mandatory consumer protection laws.

8. Right of Withdrawal (Consumers)

Consumers residing in countries where mandatory consumer protection laws grant a statutory right of withdrawal retain those rights.

Customers located within the European Union should refer to our separate Withdrawal Policy for detailed information regarding cancellation rights.

9. Retention of Title

Goods remain the property of Opalized e.K. until full payment has been received.

10. Warranty

Statutory warranty rights apply.

Normal wear and tear, improper handling, misuse, accidents, unauthorized modifications, or failure to follow care instructions are excluded from warranty coverage where legally permissible.

11. Limitation of Liability

We are liable without limitation for:

Intentional misconduct
Gross negligence
Injury to life, body, or health
Liability under mandatory product liability laws

For slight negligence, liability is limited to foreseeable damages arising from the breach of essential contractual obligations, unless mandatory law provides otherwise.

15. Applicable Law

These Terms shall be governed by the laws of the Federal Republic of Germany.

For consumers residing in other countries, mandatory consumer protection provisions of their country of residence remain unaffected.

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Changes to these Terms

We reserve the right to amend these Terms where necessary to reflect changes in legal requirements or our business operations.

The version published on this website at the time of the order shall apply.
